Prosecutor asks jury to sentence Fort Hood gunman to death

FORT HOOD, Texas (Reuters) - A prosecutor in the trial of U.S. Army Major Nidal Hasan on Wednesday asked the jury to sentence him to death, saying he deserved to die for killing 13 people and wounding 31 others in a carefully planned attack at a Fort Hood medical facility in 2009.

"Because of what he did, who he did it to, where he did it and how he did it ... he should be dealt death," prosecutor Colonel Michael Mulligan said in a closing statement to the jury.

The military jury of 13 officers who convicted Hasan of the shootings of mostly unarmed soldiers at the Fort Hood military base in central Texas will soon begin deliberations to decide his punishment.

The jury could sentence him to death or to life in prison. Judge Colonel Tara Osborn said she would instruct them on the full range of potential punishments, as mild as reprimand or military dismissal.

Hasan opened fire in a medical center on the base, one of the largest in the United States, on November 5, 2009, just weeks before he was to be deployed to Afghanistan.

He said in his opening statement on August 6 that he was the gunman and had switched sides in what he considered to be a U.S. war on Islam. An Army psychiatrist, he has said nothing since in court as to his motives. Hasan on Wednesday declined his last chance to make a statement in open court.

"I have no closing statement," Hasan said.

Prosecutor Colonel Michael Mulligan asked the jury before deliberations to sentence him to die for his crimes.

"He was trained as a doctor to save lives, but on November 5, he dealt death," Mulligan said.

The 13 murder victims were soldiers, officers, non-commissioned officers, enlisted and retired, he said.

If the jury of 11 white men, one white woman and one black woman unanimously recommends death, Hasan could face lethal injection, possibly making him the first U.S. soldier to be executed by the U.S. military since 1961.

Standby defense attorneys for Hasan attempted on Tuesday to present so-called mitigating evidence to argue for a life sentence, instead of the death penalty, including details on his background, family life, education, military experience and logs of his behavior in jail.

But Hasan objected to the effort on his behalf, telling the judge he had "overzealous defense counsel."

The judge ruled in Hasan's favor, saying: "Major Hasan is the captain of his own ship."

An American-born Muslim, Hasan earlier told mental health evaluators he wanted to become a martyr, and lawyers assisting him have said he was actively seeking the death penalty.

Hasan, 42, has disputed that claim.

Discussions in court about Hasan making little or no effort to argue for his life have taken took place without the jury present.

Hasan, 42, who uses a wheelchair after being paralyzed when shot by police to end the rampage, was convicted on Friday of 45 counts of premeditated murder and attempted premeditated murder.

Twenty family members and victims gave evidence during the prosecution's side of the sentencing phase, recounting heart wrenching stories about their loss, grief and efforts to rebuild their lives.

A death sentence for Hasan would mean the start of a lengthy process requiring the approval of the Fort Hood commanding general, and the U.S. president, in order for there to be an execution.

Mumford & Sons perform at Forest Hills reopening

(AP) ? Mumford & Sons were in the tennis spirit at the reopening of the Forest Hills Tennis Stadium in Queens.

The Grammy-winning British rockers performed a sold-out concert Wednesday for 16,000 fans at the stadium's West Side Tennis Club, which hosted the U.S. Open until 1978. Near the end of their set, the foursome played tennis onstage ? using a racket at times, and a guitar and banjo at others. They also threw balls to fans in the crowd.

Mumford & Sons played the first concert at the 90-year-old stadium, where acts from Jimi Hendrix to the Beatles to the Rolling Stones performed. It was the first show at the historic venue in more than 20 years.

Mumford & Sons electrified the crowd ? even when it rained lightly ? playing the well-known rock hits "Little Lion Man," ''I Will Wait" and "The Cave" as well as other songs from their two multiplatinum albums.

"Yes, Forest Hills, Queens, New York. We just can't believe you all came. This is amazing," keyboardist Ben Lovett said. "We were like, 'Are you sure you can invite 17,000 people to a tennis court? It hasn't happened in a long time."

The venue's prime ended when the Open moved 3 miles away to Flushing Meadows, and its days as a music venue ? where Barbra Streisand, Frank Sinatra and Bob Dylan also performed ? faded amid complaints from neighbors about noise, crowds and cars parking on residential streets.

The streets were packed Wednesday as thousands headed into the stadium, with police officers guiding cars and people on the streets.

Mumford & Sons and the crowd were loud, but not unruly during the two-hour show. The band played their folk-rock tunes with ease, and at times slowed things down as red orange lights shined and small light bulb hung in the air. They boys were like mad scientists during "Dustbowl Dance" ? singer Marcus Mumford was now on the drums and he kicked it out of his way as he headed to the front of the stage to finish singing the song. Lovett ? on the piano ? matched his energy, throwing things around and earning cheers from the crowd.

When singing "Winter Winds," Mumford even forgot some of the words, and shouted an expletive as the crowd roared and sang it for him.

"We're really proud we're here to revitalize this venue," Mumford said before singing the closer, "The Cave."

Mumford & Sons' sophomore album, "Babel," won the Grammy Award for album of the year this year.

Lawmakers to Obama: Syria strikes need our OK

WASHINGTON (AP) ? President Barack Obama's possible military intervention in Syria is already running into fierce opposition among some members of Congress, with a growing chorus of Republican and Democratic lawmakers demanding he seek congressional authorization for any strikes against the Assad regime.

In the House, Republican Rep. Scott Rigell of Virginia is asking colleagues to sign a letter to Obama urging him to reconvene Congress and seek approval for any military action. And in the Senate, even some who support punishing the Syrian government for launching alleged chemical weapons attacks are joining the call for the president to first gain Congress' approval.

"Engaging our military in Syria when no direct threat to the United States exists and without prior congressional authorization would violate the separation of powers that is clearly delineated in the Constitution," Rigell's letter argues.

A copy was obtained by The Associated Press on Tuesday.

To make their case, lawmakers are citing the 1973 War Powers Resolution. Passed after President Richard Nixon's secret Vietnam War-era operations, the law reaffirmed Congress' constitutional responsibility to declare war and put a 60-day time limit on the president's ability to take unauthorized, emergency military action. Since then, commanders in chief of both parties have maintained that the resolution is unconstitutional and have regularly disregarded it.

The Obama administration appears likely to use force in the coming days in response to reports last week of a large-scale gas attack by Syrian President Bashar Assad's forces in the Damascus suburbs. At least 100 people died.

Speaking to reporters Monday, Secretary of State John Kerry said that evidence of such an attack was "undeniable" and that intelligence strongly pointed to Assad's government ? a claim the Syrian leader called "preposterous." Kerry said that international standards against chemical weapons "cannot be violated without consequences," outlining the clearest justification yet for U.S. military action, most likely coming through sea-launched cruise missiles on regime targets.

After a decade of costly and deadly fighting in the Muslim world, Americans strongly oppose any new U.S. war in the region. Opinions in Congress are mixed as well. Republicans are split between hawks and tea party isolationists. Democrats are divided between advocates of humanitarian intervention and those who fear that even limited action risks sucking the United States into another conflict.

Despite the divides, legislators of varying political hue are trying to reassert what they claim is their power to authorize the use of force.

Sen. Tim Kaine of Virginia, a former Democratic Party chairman, said the Assad government must be held accountable for its indiscriminate violence and "despicable" chemical attacks. But he urged that proper procedures be followed.

"Absent an imminent threat to United States national security, the U.S. should not be engaged in military action without congressional approval," Kaine said. Sen. Bob Corker of Tennessee, the top Republican on the Foreign Relations Committee, has made a similar argument.

Sen. John Cornyn, R-Texas, asked only that Obama present his case to the American people and consult with Congress. "He needs to explain what vital national interests are at stake and should put forth a detailed plan with clear objectives and an estimated cost for achieving those objectives," he said.

That doesn't seem near enough for tea party favorite Rep. Justin Amash, R-Mich., who has issued a series of tweets arguing that unauthorized strikes against Syria would be unconstitutional and illegal. He is putting pressure on leadership in his own party to call Congress back into session for a debate and vote before any such action occurs.

Rep. Peter King, R-N.Y., is on the opposite end of the spectrum. "I think the president has the right to attack without the approval or consultation of Congress," he told The Associated Press by telephone. "But a wise leader would reach out."

Lawmakers are scheduled to return from a five-week recess on Sept. 9.

It's unclear what impact all the activity will yield.

When the U.S. acted with allies against Libyan dictator Moammar Gadhafi two years ago, Obama maintained military operations for more than three months without congressional authorization. He said the U.S. wasn't violating the War Powers Resolution because Americans were supporting a NATO-led operation and weren't engaged in full-blown hostilities. Despite criticism from mainly Republican lawmakers, Obama suffered no serious repercussions.

U.S.: Not trying to take out Assad with Syria response

The United States restated Tuesday that it means to drive Bashar Assad from power in Syria, but denied it would use potential U.S.-led military strikes in response to his forces? alleged chemical weapons attack to do so.

?I want to make clear that the options that we are considering are not about regime change,? White House press secretary Jay Carney told reporters at his daily briefing. ?They are about responding to clear violation of an international standard that prohibits the use of chemical weapons.?

Overall United States policy in Syria is to push Assad from power, and any (successful) military strike would plainly aim to weaken his ability to attack the rebels his forces have battled for 2? years. But Carney repeatedly said that President Barack Obama is weighing a response narrowly tailored to the alleged chemical weapons attack.

?It is our firm conviction that Syria's future cannot include Assad in power, but this deliberation and the actions that we are contemplating are not about regime change,? the spokesman insisted.

Obama has not made a final decision on the course of action and might still stop short of using force, Carney said.

At the same time, Carney escalated the rhetoric about the Assad regime?s alleged Aug. 21 chemical weapons attack, saying that failing to punish Syria would pose a ?significant? threat to the United States.

?Absolutely, allowing the use of chemical weapons on a significant scale to take place without a response would present a significant challenge to or threat to the United States' national security interests,? Carney said.

Including the United States itself? ?Correct,? he said. ?To allow it to happen without a response would be to invite further use of chemical weapons.?

Carney also renewed the Obama administration?s pledge to disclose evidence it has gathered to buttress the charge that the Assad regime carried out large-scale chemical weapons attack on civilians aligned with the opposition. ?I think you can expect it this week,? he said.

But Carney, prodded by reporters to explain why the United States is so sure Syrian government forces carried out the attack, seemed to argue that the report was unnecessary to make the case against Assad.

?I'm not aware of any doubt that exists,? he said.

?We see no evidence of any alternative scenario. The regime has already used chemical weapons in this conflict against its own people on a small scale,? he said.

?It has maintained firm control of the stockpiles of chemical weapons in Syria. It has the rockets and the rocket capability that were employed in this chemical weapons attack. And it was engaged in an assault against these neighborhoods prior to the use of chemical weapons and in the aftermath of the use of these chemical weapons. You would have to be credulous indeed to entertain an alternative scenario that could only be fanciful,? he said.

But other possibilities exist: Accidental launch. Launch by a rogue Syrian military officer. A conventional shell striking a chemical weapons cache (depending on the substance). Launch by a third party like forces fighting for Assad but answering to Iran.

Asked whether the United States government had looked into those possibilities and ruled them out, National Security Council spokeswoman Bernadette Meehan referred Yahoo News to past statements from Carney and Secretary of State John Kerry.

Asked whether Syria?s government could still take steps to forestall the United States reaction, whatever that turns out to be, Meehan demurred.

?Since the president hasn?t made a decision on how to respond, we can?t speculate on the second question,? she said.
